2) vendita di cosa futura: è un tipo di vendita ad effetti obbligatori, e non reali, infatti la proprietà passa in capo al compratore quando la cosa viene a esistenza: es. vendita di appartamento sulla carta-> la proprietà si trasferisce quando il bene viene edificato; vendita del raccolto di un anno agrario. Il contratto è nullo se la cosa non viene a esistenza.
