La primera sentencia puede ser absolutoria tanto porque a) se declara la inocencia de sujeto interviniente (lo cual no necesariamente implica que el hecho realizado no sea delito), o b) porque el hecho penal se considera inexistente como tal (el hecho no es delito), o c) porque el hecho previo se encuentra prescrito y así lo declara la sentencia (el hecho fue delito pero sus efectos ya no pueden seguir vigentes).
