Source text - Slovak Vymožiteľnosť práva v Slovenskej republike
V súčasnej dobe je vymožiteľnosť práva v Slovenskej republike celospoločensky diskutovanou témou. Vzhľadom na dynamiku spoločenského vývoja fyzické ako aj právnické osoby prichádzajú do kontaktu so súdmi oveľa častejšie. Jedným zo základných prvokov vzájomného vzťahu so súdmi je práve dôvera. Spôsob fungovania súdov, prípadná nízka vymožiteľnosť práva a v neposlednom rade stav legislatívneho prostredia majú vplyv na každodenný život tak občana ako aj podnikateľských subjektov.
Stav vymožiteľnosti práva vo všeobecnosti je vizitkou právneho a ústavného štátu, celkovej právnej kultúry a aktuálneho stavu spoločnosti a spokojnosti obyvateľstva.
Vzhľadom na členstvo Slovenskej republiky v Európskej únii problematika vymožiteľnosti práva nemá len vnútroštátny dosah, ale je potrebné ju vnímať aj v celoeurópskom kontexte a má tiež zásadný význam tak z hľadiska právno-teoretického, ako aj z pohľadu aplikačnej praxe.
Vymožiteľnosť práva je jedným z pilierov demokratického štátu. Právo domáhať sa svojich práv občanom garantuje priamo Ústava Slovenskej republiky. Podľa článkov Ústavy Slovenskej republiky č. 46 až 50 sa každému zaručuje právo na súdnu a inú právnu ochranu. Každý má právo, aby bola vec prerokovaná pred súdmi bez zbytočných prieťahov, verejne za osobnej účasti, tak aby sa mohla ku všetkým skutočnostiam vyjadrovať.
Od celospoločenských zmien v roku 1989 sa podstatným spôsobom zvýšila kontrola justície verejnosťou. Uvedené zmeny však podstatným spôsobom zmenili aj legislatívne prostredie a celospoločenskú situáciu, čo prinieslo dramatické zvýšenie počtu súdnych sporov, na ktoré súdy neboli pripravené ani po personálnej ani po materiálnej stránke.
V súvislosti so vstupom Slovenskej republiky do Európskej únie bolo do slovenského právneho poriadku transponovaných obrovské množstvo smerníc. Za posledné desaťročie možno badať určité zníženie počtu starších súdnych sporov, zrýchlenie priebehu súdneho konania a skvalitnenie práce súdov.
Vzhľadom na aktuálnu ekonomickú a sociálnu situáciu, je však vývoj situácie v oblasti vymožiteľnosti práva vnímaný verejnosťou, rovnako aj podnikateľským prostredím negatívne.
Takéto vnímanie justičného a legislatívneho prostredia má rôzne dôvody, či už právne alebo mimoprávne. Jedným z dôvodov súčasného stavu súdnictva je vyťaženosť súdov nad zvládnuteľnú mieru. Vymožiteľnosť práva ovplyvňuje taktiež celý rad okolností v mimoprávnej rovine. Činnosť súdov negatívne ovplyvňuje napríklad aj nedostatočné personálne vybavenie, chýbajúce technické prostriedky a pod. Uvedené ako i mnohé ďalšie faktory môžu v konečnom dôsledku znížiť účinnosť právnych prostriedkov, pričom samotný občan, prípadne podnikateľský subjekt nevie a nemusí vedieť rozpoznať hlavný dôvod alebo príčinu nevymožiteľnosti svojho práva a spravodlivosti.
Práve z dôvodu obnovy dôvery občanov v právny štát, k jeho inštitúciám a samotnej dôvery v spravodlivosť, si súčasná Vláda Slovenskej republiky zakotvila do svojho Programového vyhlásenia vlády Slovenskej republiky na roky 2010 – 2014 medzi najdôležitejšie ciele výrazné zlepšenie v oblasti vymáhateľnosti práva a boja proti korupcii.
Ministerstvo spravodlivosti Slovenskej republiky vzhľadom na podstatnú úlohu, ktorú zohráva vymožiteľnosť práva v našej spoločnosti, sústavne hľadá riešenia, ktoré by nielen zlepšili vymožiteľnosť práva, ale ktoré by prispeli aj ku vytvoreniu podmienok pre modernizáciu súdneho konania jeho spružnením, zvýšením nezávislosti, odbornosti a zrýchleniu súdneho konania. Zlepšenie vymožiteľnosti práva by pozitívne vplývalo aj na podnikateľské prostredie.
Právna istota účastníka právneho vzťahu založeného napríklad zmluvou, predstavuje skutočnosť, že jeho práva budú naplnené a v opačnom prípade má k dispozícii efektívny nástroj na ich vymáhanie v reálnom čase, to znamená v čase, kedy je vymáhanie pohľadávky hospodárne, čo je základom fungujúcich podnikateľských vzťahov. Úroveň vymožiteľnosti práva má tak zásadný vplyv aj na podnikateľské prostredie v Slovenskej republike. Poslednou zmenou napomáhajúcou k zlepšeniu podnikateľského prostredia bolo zavedenie elektronizácie Obchodného vestníka, ktorá je realizovaná od prvého júla 2011. Elektronizácia Obchodného vestníka umožnila aj skrátenie lehôt na publikáciu z niekoľkých mesiacov na pár dní.
Vykonávanie zmien v súdnictve a vybudovanie dôveryhodnej justície sa stali prioritou vlády a ich účelom je zlepšiť nielen podnikateľské prostredie, ale aj zásadným spôsobom zlepšiť vymožiteľnosť práva v Slovenskej republike.
Ministerstvo spravodlivosti Slovenskej republiky pod vedením súčasnej ministerky spravodlivosti Slovenskej republiky vykonáva viaceré kroky, s cieľom vybudovať dôveryhodnú a efektívnu justíciu, ktorá by zásadnou mierou pomohla zlepšiť podnikateľského prostredia na Slovensku a podporovala konkurencieschopnosť Slovenskej republiky.
Ministerstvo spravodlivosti Slovenskej republiky na svojich internetových stránkach prvýkrát zverejnilo prehľad o vybavovaní agend na okresných a krajských súdoch v Slovenskej republike, ktorý odbornej ako aj širšej verejnosti poskytuje relevantné dáta pre dotvorenie obrazu o činnosti súdov. Štatistiky o vybavovaní vecí na konkrétnych súdoch, z ktorých je zrejmá vyťaženosť sudcov na jednotlivých súdoch, neboli doteraz v takejto podobe zverejňované a nemali k nim prístup dokonca ani samotní sudcovia.
Za splnenia zákonných podmienok je možné pristúpiť k elektronickému doručovaniu písomností, je zavedené využívanie elektronického podpisu v konaní na Obchodnom registri, je zabezpečený prístup verejnosti k rôznemu druhu informácií prostredníctvom verejne dostupných sietí a rovnako pravidelne sa rezort spravodlivosti snaží vzdelávať sudcov a súdnych zamestnancov.
V snahe o zrýchlenie súdnych konaní a posilnenia právnej istoty, bol do dovolacieho konania zavedený tzv. revízny princíp, podľa ktorého už Najvyšší súd Slovenskej republiky ako súd dovolací v prípade odlišného názoru ako súd nižšieho stupňa môže konanie aj ukončiť a nielen ako v minulosti uplatňovať kasačný princíp, rušiť rozhodnutie súdu nižšieho stupňa, čo reálne v praxi iba zbytočne predlžovalo samotné konanie. V minulosti mohlo súdne konanie trvať niekoľko rokov a senát najvyššieho súdu rozhodnutie zrušil a vec vrátil opäť na prvostupňový súd. Následne mohlo prejsť ďalších niekoľko rokov a iný senát najvyššieho súdu mohol mať v tejto veci odlišný právny názor, resp. vec opätovne vrátiť na ďalšie konanie. Pre samotných účastníkov konania to neznamenalo nič iné, ako príliš zdĺhavé súdne konanie.
Súčasné vedenie rezortu spravodlivosti nadviazalo na dlhoročné snahy vytvoriť v legislatíve väčšie možnosti pre mimosúdne riešenie sporov, ktoré pozitívne slúžia predovšetkým podnikateľskej verejnosti. Pre arbitráž, teda mimosúdne riešenie sporov, môže štát len vytvoriť legislatívne podmienky. Reálne využitie v praxi, je potom už vecou podnikateľskej verejnosti, napríklad do akej miery budú mať vo svojich zmluvách zakotvené arbitrážne doložky. Je pravdou, že mnohé vyspelé krajiny riešia nie zanedbateľnú časť sporov práve cez mimosúdne formy, teda prostredníctvom arbitráže alebo mediácie.
Významné zmeny ohľadom vymožiteľnosti práva nastali v oblasti právnej istoty spotrebiteľov a práve tieto zmeny prispeli k posilneniu dôvery spotrebiteľov.
Ministerstvo hospodárstva Slovenskej republiky spolu s Ministerstvom spravodlivosti Slovenskej republiky, v súlade s predpismi Európskej únie, reagovali na vývoj trhu a v posledných rokoch tak vstúpili do platnosti nové právne predpisy slúžiace na ochranu práv spotrebiteľov. Významnými sú v tejto súvislosti zmeny právnych predpisov týkajúce sa všeobecnej bezpečnosti výrobkov, dvojročnej záruky zo zákona, regulácie klamlivej a porovnávacej reklamy a ďalšie, ktoré priniesli spotrebiteľom množstvo výhod.
Novela zákona o konkurze a reštrukturalizácii rovnako prináša pozitívne zmeny v oblasti vymožiteľnosti pohľadávok a je zásadným opatrením smerujúcim k lepšej vymožiteľnosti práva. Cieľom rezortu spravodlivosti je riešiť tie oblasti bankrotovej úpravy, ktoré sa v doterajšej aplikačnej praxi ukázali ako málo efektívne alebo nedostatočným spôsobom sformované a zároveň upraviť definíciu predĺženia spôsobom bežným vo vyspelých zahraničných právnych úpravách, spriechodniť veriteľské návrhy na vyhlásenie konkurzu z dôvodu platobnej neschopnosti dlžníka. V praxi sa tak umožní veriteľom iniciovať konkurz voči dlžníkovi skôr, teda ešte v čase, keď dlžník má nejaký majetok a zároveň dáva možnosť veriteľom podať návrh na vyhlásenie konkurzu i bez toho aby mali uznanú pohľadávku dlžníkom alebo vykonateľnú pohľadávku. Zároveň sa zvyšuje zodpovednosť štatutárnych orgánov dlžníkov za nepodanie dlžníckeho návrhu na vyhlásenie konkurzu včas. Za účelom zosúladenia konkurznej právnej úpravy s judikátom Európskeho súdu pre ľudské práva sa zavádza sporové posúdenie návrhu na vyhlásenie konkurzu. Reálny, dôsledkom bude právo dlžníka predkladať dôkazy vyvracajúce tvrdenie veriteľa a právo byť vypočutý pred vyhlásením konkurzu. V súlade so štandardami európskeho práva sa taktiež zavádza právo prihlasovať pohľadávky počas konkurzného konania.
Hlavným cieľom súčasného vedenia rezortu spravodlivosti je, aby sa zavádzali účinné opatrenia v našom súdnictve spojené nie len s prijímaním noviel právnych predpisov a preberaním smerníc Európskej únie, ale aby naše súdnictvo prešlo dôkladnou reformou, tak aby výsledok jeho činnosti mohol slúžiť občanom na ochranu ich práv a právom chránených záujmov.
Účinné fungovanie súdov a samotnej justície si vyžaduje aj zmenu v technicko-administratívnej oblasti justície.
Ministerstvo spravodlivosti Slovenskej republiky v súčasnej dobe pripravuje projekt Elektronizácie súdnictva, ktorého spustenie je naplánované na obdobie rokov 2012/2013. Cieľom elektronizácie súdnictva je zefektívniť a zrýchliť súdne konanie aj prostredníctvom dostupných technických prostriedkov. Pod elektronizáciu súdnictva sa plánuje zahrnúť predovšetkým elektronický súdny spis, rýchle elektronické doručovanie písomností zo súdu, nahrávanie pojednávaní alebo prepis hovoreného slova. Zavedením plne elektronického súdneho spisu by sa vo výraznej miere znížil priestor pre korupčné správanie všetkých účastníkov konania, zvýšila by sa právna istotu a hlavne transparentnosť pre účastníkov právnych vzťahov.
Translation - English Law Enforcement in the Slovak Republic
Presently, law enforcement in the Slovak Republic is a widely-discussed topic in the society. Given the dynamics of social development, both natural and legal persons come into contact with the courts more often. One essential element of the society's relationship with the courts is confidence. The courts' manner of functioning, the alleged poor law enforcement and not least of all, the status of the regulatory environment affect the daily lives of both citizens and entrepreneurial entities.
State of law enforcement in general is the advert of a legal and constitutional state, the overall legal culture and the current state of the society and the satisfaction of the population.
Considering the membership of the Slovak Republic in the European Union, the issues of law enforcement not only have national reach, but need to be seen in a European context and are crucial in both legal and theoretical terms as well as in terms of practical application.
Law enforcement is one of the pillars of a democratic state. Upholding citizens' rights is guaranteed to the populace directly by the Constitution of the Slovak Republic. Under Articles of the Constitution of the Slovak Republic No. 46 to 50, each citizen is guaranteed the right to a fair trial and other legal protection. Everyone has the right to have their case dealt with in the courts without undue delays, in public and with his/her personal participation, so that he/she can comment on all the facts.
Since the society-wide changes of 1989, the control of justice by the public has substantially increased. These changes, however, substantially changed both the legislative environment and the situation of the society as a whole, which resulted in a dramatic increase in litigations, for which the courts were unprepared from both the material and personal point of view.
In connection with the accession of the Slovak Republic to the European Union, a huge number of directives and regulations were transposed in the Slovak legal order. Over the last decade one can see a certain reduction in the number of pending litigations, acceleration of legal proceedings and an improvement in the work of the courts.
Given the current economic and social situation, any positive developments in the field of law enforcement are perceived as impossible by people in both the public and business environment.
This perception of the judicial and legislative environment has a variety of causes, legal and otherwise. One reason for the current state of the judiciary is the extreme workload of the courts. Law enforcement is also affected by a number of extralegal circumstances. Inadequate staffing, lack of technical means and the like adversely affects the operation of the courts as well. These as well as many other factors may ultimately reduce the effectiveness of legal remedies, and a mere citizen or business entity is neither able nor allowed to recognize the main reason or cause of the unenforceability of his rights and justice.
In order to restore citizens' confidence in the rule of law, its institutions and confidence in justice itself, the current Slovak government, in the Policy Statement of the Government of the Slovak Republic for the years 2010 – 2014, embedded among the most important objectives, - significant improvement in the area of law enforcement and the fight against corruption.
The Ministry of Justice of the Slovak Republic, with regard to the essential role played by law enforcement in our society, is continuously looking for solutions that would not only improve law enforcement, but would also contribute to creating conditions for the modernization of court proceedings by making them more flexible and increasing the autonomy, professionalism and speed of court proceedings. Improving law enforcement would also positively influence the business environment.
Legal certainty of a party to a legal relationship, based for instance on an agreement, is the basis for conviction that the parties'/party's rights will be fulfilled and in case of any infringement the party has at its disposal an effective tool to recover its rights in real time, i.e. at the time when recovery of its claim is economical, which is essential for the functioning of business relations. The level of law enforcement thus has a substantial impact on the business environment in the Slovak Republic. The last change contributing to improving the business environment was the introduction of computerization of the Commercial Bulletin, which started on 1 July 2011. Commercial Journal Computerization allows the shortening of publication from several months to a few days.
Court reform and building a credible justice system have became priorities for the Slovak government and the purpose of the above is both improvement of the business environment and substantial improvement of law enforcement in the Slovak Republic.
The Ministry of Justice of the Slovak Republic, led by the current Minister of Justice of the Slovak Republic has been carrying out several steps in order to build a credible and effective judiciary which would significantly help improve the level of the business environment in Slovakia and promote the competitiveness of the Slovak Republic.
On its website, the Ministry of Justice of the Slovak Republic published for the first time an overview of files being processed at district and regional courts in the Slovak Republic, which both for the professional and the wider public provides relevant data for having a complete picture of the activity of the courts. Statistics on the handling of cases in specific courts, from which follows the apparent occupancy of judges in various courts, have not yet been published in such a form and even the judges themselves do not have access to them.
When statutory conditions are fulfilled, it is possible to deliver documents and papers electronically; the use of electronic signature was introduced in proceedings held at Commercial Register, access to various types of information by public is ensured through publicly available networks and the department of justice also seeks to educate judges and court employees on a regular basis.
In order to speed up court proceedings and enhance legal certainty, the so-called Revisory Principle was introduced into appeal proceedings, according to which the Supreme Court of the Slovak Republic, as an appellate court in the case of having a different opinion than the lower court, may also terminate the proceedings, and as was the case in the past, apply the principle of cassation to cancel the decision of a lower court, which in actual practice only unnecessarily prolonged the proceedings. In the past, court proceedings could take several years and the senate of the Supreme Court of Appeal could set aside the decision and return the case back to the court of first instance. Consequently, a few more years could pass and another senate of the Supreme Court of Appeal could have a different legal opinion in the respective case, i.e. to return the case for further proceedings. For the parties to the proceedings themselves this implies nothing but a very lengthy trial.
The current management of the Justice Department has picked up the threads of long-term efforts to create greater opportunities in the legislation for amicable settlement of disputes, which mainly benefits the entrepreneurial public. For arbitration, i.e. amicable settlement of disputes, the state can only create legislative conditions. Real use in practice is then a matter of the entrepreneurial public, e.g. to which extent the entrepreneurs will embody arbitration clauses in their contracts. It is true that many developed countries do settle a considerable portion of their disputes through amicable settlement, namely through arbitration or mediation.
Significant changes regarding law enforcement have occurred in the field of legal certainty of consumers and these changes contributed to the strengthening of consumer confidence.
The Ministry of Economy of the Slovak Republic, together with the Ministry of Justice of the Slovak Republic, in compliance with regulations of the European Union, have responded to market developments and thus new legislation serving the protection of consumers' rights have been put into force in recent years. Of particular importance in this context are changes to legal regulations concerning general safety of products, a two-year law-mandated warranty and regulation of misleading and comparative advertising that have brought many benefits to consumers.
The amendment to the Act on Bankruptcy and Restructuring (Zákon o konkurze a reštrukturalizácii) has also brought positive changes in the area of claims recovery and is a key measure aimed at better law enforcement. The objective of the justice department is to address those areas of bankruptcy law which so far in practical application have proved to be inefficient or insufficiently worded and simultaneously to modify the definition of extension in the manner customary in developed foreign legal regulations, to make feasible the creditor’s petitions for declaring bankruptcy due to insolvency of the debtor. In practice, therefore, creditors can initiate bankruptcy proceedings against debtors earlier, so at the time when a debtor has property; also it gives creditors the opportunity to submit a petition for declaring their debtors bankrupt even if the creditor's claim was not accepted by the debtor or if the creditor does not have an enforceable claim. Simultaneously the legal responsibility of statutory bodies of debtors for failure to file an application to declare them bankrupt on time is thus increased. In order to align the bankruptcy law with judicial decisions of the European Court of Human Rights, the “assessment of the creditor’s petition for bankruptcy order” (sporové posúdenie návrhu) has been introduced. A real impact will be the debtor's right to submit evidence rebutting assessments of the creditor and the right to be heard before issuing the bankruptcy order. In accordance with the standards of European law, the right to lodge claims during the bankruptcy proceedings has also been introduced.
The main objectives of the actual management of the Justice Department are to implement effective measures in our judicature, not only as associated with the adoption of amendments to legislation and transposing the directives of the European Union, but also that our judicature undergoes a thorough reform, so that the result of its activities can serve the citizens, i.e. to protect their rights and interests protected by law.
Effective functioning of the courts and the very justice also requires a change in technical and administrative are of the judiciary.
The Ministry of Justice of the Slovak Republic is currently preparing the project Computerization of the Justice System, which has a planned launch window of 2012/2013. The aim of computerization of the justice system is to streamline and expedite proceedings by means of the technical tools available. Computerization of the justice system specifically includes an electronic court file, fast electronic delivery of documents from the court, recording of court proceedings or transcription of spoken word. The introduction of a fully electronic case file would greatly reduce corrupt behaviour of all parties to the proceedings, and would increase legal certainty and transparency, especially for participants in legal relations.

Podľa § 157 ods. 3 O.s.p. ak je na pojednávaní vyhlásený rozsudok za prítomnosti všetkých účastníkov alebo ich zástupcov, ktorí sa vzdajú odvolania, uvedie súd v odôvodnení rozsudku iba predmet konania a ustanovenia zákona, podľa ktorých rozhodol.
Predmetom konania je rozvod manželstva na návrh navrhovateľky tunajšiemu súdu podaný dňa 28.10.2011 a zdôvodnený nadviazaním známosti odporcu sinou ženou a jeho následným agresívnym správaním sa k navrhovateľke.
Podľa § 18 ods. 1 Zák. o rodine manželia sú si v manželstve rovní v právach a povinnostiach. Sú povinní žiť spolu, byť si verní, vzájomne rešpektovať svoju dôstojnosť, pomáhať si. starať sa spoločne o deti a vytvárať zdravé rodinné prostredie.

Podľa § 23 ods. 1 Zák. o rodine súd môže manželstvo na návrh niektorého z manželov rozviesť, ak sú vzťahy medzi manželmi tak vážne narušené a trvalo rozvrátené, že manželstvo nemôže plniť svoj účel a od manželov nemožno očakávať obnovenie manželského spolužitia.
Podľa § 23 ods. 2 veta prvá Zák. o rodine súd zisťuje príčiny, ktoré viedli k vážnemu rozvratu vzťahov medzi manželmi, a pri rozhodovaní o rozvode na ne prihliada.
Za príčinu rozvratu vzťahov medzi manželmi súd považuje ich rozdielny prístup k manželskému spolužitiu a zabezpečovaniu potrieb rodiny, názorové nezhody a stratu vzájomnej dôvery, vyústiace do obojstrannej nevery a ukončenia spoločného bývania.
O trovách konania súd rozhodol podľa § 144 veta prvá O.s.p.
Poučenie: Proti rozsudku súdu I. stupňa možno podať odvolanie. Nakoľko sa však účastníci konania prítomní pri vyhlásení rozsudku vzdali voči nemu práva opravného prostriedku do zápisnice súdu, je odvolanie neúčinné.

Gemäß § 157 Absatz 3 der Zivilprozessordnung, wenn bei der Gerichtsverhandlung das Urteil in Anwesenheit von allen Parteien oder deren Vertreter die auf die Berufung verzichteten, ist verkündet, so hat das Gericht nur das Streitobjekt und die Bestimmungen des Gesetzes, nach denen das Gericht entschiedet hat, in der Begründung anzuführen.
Das Handlungsobjekt ist die Scheidung der Ehe auf Antrag der Antragstellerin dem hiesigen Gericht, gestellt am 2011.10.28 und begründet mit dem Kennenlernen des Antragsgegners mit einer anderen Frau und nachfolgendem aggressiven Verhalten gegenüber der Antragstellerin.
Gemäß § 18 Abs. 1 des Familiengesetzes haben die Ehepartner gleiche Rechte und Pflichten. Sie haben die Pflicht zusammen zu leben, gegenseitig treu zu sein, ihre Würde zu respektieren, sich einander zu helfen, gemeinsam für Kinder zu sorgen und gesundes Familienmilieu zu bilden.

Gemäß § 23 des Familiengesetzes kann das Gericht aufgrund des Antrags eines der Ehepartner die Ehe scheiden, falls die Beziehung zwischen den Ehepartnern so ernsthaft und dauerhaft zerrüttelt ist, dass die Ehe ihren Zweck nicht mehr erfüllen kann und von den Ehepartnern die Erneuerung des ehelichen Zusammenlebens nicht erwartet werden kann.
Gemäß § 23 Abs. 2 erster Satz des Familiengesetzes, das Gericht stellt die Ursachen fest, die zu einer nachhaltigen Zerrüttelung der Beziehungen zwischen den Ehegatten geführt haben, und bei der Entscheidung über die Ehescheidung diese berücksichtigt.
Die Ursache für den Zusammenbruch der Beziehungen zwischen den Ehegatten das Gericht haltet ihre unterschiedliche Einstellung auf das Eheleben und Sicherstellung der Bedürfnisse der Familie, Meinungsverschiedenheit und Verlust des Vertrauens, das gegenseitige Untreue zur Folge hatte und Beendigung des gemeinsamen Haushalts.
Über die Gerichtskosten entschied das Gericht gemäß § 144 erster Satz der Zivilprozessordnung.
Belehrung: Die Parteien haben die Möglichkeit, gegen das Urteil des Gerichts der ersten Instanz Berufung einzulegen. Gegen dieses Urteil ist keine Berufung rechtswirksam, weil die Parteien des Verfahrens nach der Urteilsverkündigung auf die Berufung durch die Aufnahme ins Gerichtsprotokoll verzichteten.
Der Ehepartner, der bei der Eheschließung den Familiennamen des anderen Ehepartners als den gemeinsamen Ehenamen annahm, kann dem Standesamt innerhalb von drei Monaten nach der Inkrafttreten dieses Beschlusses über die Ehescheidung Bescheid geben, dass er/sie seinen/ihren vorherigen Familiennamen wieder annimmt (§ 27 Absatz 1 des Familiengesetzes).

1, Mit Rechtshitleersuchen vom 12. April 2010, beim hiesigen Gericht einqegangen
am 10. Mai 2010, stellt das Bezirksgericht Bratislava I, Bratislava, Slowakei,
eln Begehren um internationale Rechtshilte, mit welchem um die DurchfOhrung
eines Editionsve rfahrens bei der Credit Suisse. Paradep latz 8. 8001 Zurich,
ersucht wird. Verlangt wird die Beantwortung der Frage nach Vermogenswerten
des Erblassers xxx, geboren 30 August 1919. gestorben 22. August
2009 bei der Credit Suisse, Zurich , und die Herausgabe von Unter1agen im Zusammenhang
mit dieser Erbschaftssache .
2. Sowohl die Slowakei als auch die Schweiz haben das Haager Uberemkommen
ober die Beweisaufnahme im Ausland in Zivil - oder Handelssachen vom
18. März 1970 (HBewUe70) unterzeichnet, weshalb dieses vcrueqeno zur Anwendung
gelangt.
3. Das dem Ersuchen zugrundeliegende Verfahren besitzt erkermbarerweise
evnrecotacren Chara kter. Damit ist das Rechtshilfeersuchen antraqsqemäss
durchzufiihren.
1. Art . 9 HBewUe70 bestimrnt, dass beim Votlzug des Rechtshilfeersuchens
das Recht des ersuchten Staates anzuwenden ist, mithin getangt im vorliegenden
Fail Schwelzensches Recht zur Anwendung. Da der Bund auf dem Gebiet de r interoanonaien
Zivilrechtshilfe nicht Iegiferiert hat. gelten die entsprechenden kantonalen
Gerichtsorganis ationsgesetze oder Zivilprozessordnungen, was sich aus
Art. 122 Abs. 2 BV ergibt. Samit ist zurchertsches verfahrensrecht massgebend
2. Das um Rechtshilfe ersuchte Gerich! wendel die geeigneten Zwangsmassnahmen
in den Fällen und in dem Umfang an, wie es das nationale (kantonale)

3.1 Die Zivilpmzessordnung des Kantons Zurich (ZPO) posluliert ŕe r Drine
eine generelle prozessu ale Edilionspflicht, dies hinsichtlich aller sich in deren
Gewahrsam belindiichen Urkunden (§ 184 ZPO), Die vorliegend anwendbare
Zurcherische Zivilprozessordnung siehl aber auch in den §§ 158 - 160 ZPO
Zeugnisverweigerungsrechte, resp. in § 184 ZPO ein entsprechendes Editionsverweigerungsrecht
vor. Danach ist auch ein Nchtvertahrensbetešiqter qrunosätzIich
verpflich tet, die in seinem Gewahrsam befindlichen Urkunden dem Gencht
einzureichen , sofem er alch nicht sinngemäss auf die erwähnten VerweigerungsgrOnde
gemäss §§ 158 -160 ZPO berufen karin.
3.2 Die Verweigerungsgrunde gemäss §§ 158 - 160 ZPO erfassen indessen
die unter das Bankgeheimnis fallenden Perscnen gerade nicht , indem ihnen die
ZPO kein Editionsverweigerungsrecht in dem Sinne einräumt, als dieses sich aus
dem Bankgeheimnis ableiten wi.lrde (VPB 49, 1985, 89). Auch das Bundesgesetz
Ober die Banken und Sparkassen behält ausorucsnch die Editionspflicht aufgrund
eidgenôssischer unci kantonaler Bestimmungen vor (BankG Art. 47 lift. 4, zum
Ganzen siehe Walter/Jagmetti/GreinerlSchwander, Intemationales Privat- und
Verlahrensrecht,61 E, N 11 mit Hinweis auf PKG 1993 Nr. 47, wetcner Entscheid
auf der gegenOber der ZPO in den fraglichen Passagen íoentíscren Zivilprozessordnung

4. Zusammenfassend ist die Credit Suisse, Zurich , im Sinne der obigen Efwägungen
autzutordern. rechtshilfeweise die Frage nach allfälligen Vermôgenswerten
des Erblassers Tibor Klačanský bei ihr zu beanlworten, den Stand der
entsprechenden Vermôgenswerte (Konten, Wertpap iere, Safes, sceroucher.
Edelmetalle), die Bankbeziehungen und Verbi ndlichkeiten des Erblassers auf den
Todeszeitpunkt (22. August 2009) hin zu nennen sowie die entsprechende lnformationen
belegenden, zur Edition begehrten Untertagen - insbesondere im Zu111mmenhang mit der Kundennummer des Erbtassers 0835-92195-4: Kunde

Translation - Slovak Samosudca berie do úvahy:
1. V žiadosti o právnu pomoc z 12. apríla 2010, ktorá bola doručená tunajšiemu súdu 10. mája 2010, sa Krajský súd Bratislava I, Bratislava, Slovensko, obrátil so žiadosťou o medzinárodnú právnu pomoc vo veci dedičského konania v súvislosti s finančnou inštitúciou Credit Suisse, Para-deplatz 8, 8001 Zürich. Požadovala sa odpoveď na otázku týkajúcu sa aktív poručiteľa Tibora Klačanského, narodeného dňa 30. augusta 1919, zosnulého dňa 22. augusta 2009, ktoré mal menovaný uložené v banke Credit Suisse, Zürich, ako aj o vydanie podkladov súvisiacich s týmto dedičstvom.
2. Rovnako Slovensko ako aj Švajčiarsko podpísali Haagsku dohodu z 18. marca 1970 o skúmaní dôkazov v zahraničí v občianskych alebo obchodných záležitostiach (HbewUe70, Haager Beweisaufnahmeübereinkommen), a preto sa postupovalo v zmysle tohto dokumentu.
3. Konanie v súvislosti s týmto vyžiadaním má preukázateľne občiansko-právny charakter. Preto sa žiadosti o právnu pomoc v zmysle návrhu vyhovuje.
II.
1. Ods. 9 HbewUe70 stanovuje, že pri výkone žiadosti o právnu pomoc sa postupuje podľa prá-va štátu ktorému bola žiadosť postúpená, preto sa v predloženom prípade bude postupovať podľa švajčiarskeho práva. Pretože Švajčiarska konfederácia v oblasti medzinárodnej civilno-právnej pomoci uvedené neustanovila zo zákona, platia príslušné kantonálne zákony o spoločnostiach alebo civilný súdny poriadok, čo vyplýva aj z Článku 122 ods. 2 BV. Týmto je zürižské procesné právo rozhodujúce.
2. Súd ktorý je požiadaný o právnu pomoc používa vhodné donucovacie opatrenia v tých prípa-doch a v takom rozsahu, v akom to predpokladá národné (kantonálne) právo pre vybavenie žiadosti vnútroštátnych inštitúcií alebo za rovnakým účelom podaná žiadosť jednej strany (Článok 10 ods. 1 HbewUe70).
3.1 Civilný súdny poriadok kantónu Zürich (ZPO, Zivilprozessordnung) postuluje pre tretie osoby všeobecnú ohlasovaciu povinnosť v súvislosti so všetkými listinami ktoré má v svojej správe (§ 184 ZPO). Existujúci aplikovateľný zürižský civilný súdny poriadok stanovuje aj v §§ 158 – 160 ZPO právo odopretia svedectva, resp. v § 184 ZPO príslušné právo na odopretie ohlaso-vacej povinnosti. Podľa toho je aj osoba, ktorá nie je účastníkom súdneho procesu zásadne povinná postúpiť listiny súdu, ktoré má v držbe, pokiaľ sa nemôže oprávnene odvolať na už spomenuté právo na odopretie podľa §§ 158 – 160 ZPO.
3.2 Dôvody na odopretie podľa §§ 158 – 160 ZPO sa však nevzťahujú na osoby, ktoré sú povinné zachovávať bankové tajomstvo, lebo ZPO im nedáva právo na odopretie ohlasovacej povin-nosti, nakoľko uvedené sa dá odvodiť z toho, čo je stanovené o bankovom tajomstve (VBP 49, 1985, 89). Aj spolkový zákon o bankách a sporiteľniach výslovne stanovuje ohlasovaciu po-vinnosť na základe prísažných a kantonálnych ustanovení (Zákon o bankách /BankG/ Článok 47 (4), ďalej pozrite Walter/Jagmetti/Greiner/Schwander, Medzinárodné súkromné a procesné právo, 61 E, N 11 s odkazom na PKG 1993 č. 47, ktorého rozhodnutie vzhľadom na ZPO v otáznych pasážach sa zakladá na identickom civilnom súdnom poriadku kantónu Graubu-enden).
4. Stručne povedané, Credit Suisse, Zürich, je v zmysle hore uvedených skutočností vyzvaná, aby odpovedala na otázky súvisiace s právnou pomocou vo veci aktív po poručiteľovi xxx, aby uviedla stav odpovedajúcich aktív (bankové účty, cenné papiere, schránky, vkladné knižky, drahé kovy), bankové spojenia a záväzky poručiteľa ku dňu smrti (22. august 2009), ako aj príslušné informácie v súvislosti s dedičstvom – predovšetkým v spojení so zá-kazníckym číslom poručiteľa: 0835-92195-4; zákazník č.92195 Ret; depozit: 0835-92195-45 a poslať súdu do určenej lehoty.
