From time to time, at trade shows or other industry events, you may have the occasion to communicate and interact with a competitor. In this sense, you are required to use extreme care when talking with competitors or potential competitors and if a competitor wants to discuss a subject that you think might cause antitrust concerns, you should tell him or her that you can’t talk about the topic.

PMG requires all such interactions to be documented. All employees must complete and submit a report after receiving the minutes of the meeting. In case there were not official minutes of the meeting a report must be submitted right after interacting with a competitor. The report must be emailed to the Local Compliance Representative or Group Compliance Manager.

Agenda: Each association meeting should have a clearly worded and unambiguous agenda. Should this agenda be ambiguous, the employee must not attend the meeting until PMG is appropriately informed about its content and does not oppose that employee attending the meeting. If the employee wants to oppose an agreement or discussion, it should ask for a dissenting opinion to be recorded into the minutes. If discussions in a meeting drift into anti-competitive subjects, the employee should openly distance oneself from the discussions, leave the meeting immediately and ask for the exit to be recorded into the minutes
