Constituer le cas échéant tout séquestre nécessaire à l’accomplissement des conditions de la vente.
Consentir toutes délégations aux créanciers inscrits s’ils existent.
Vendre le bien dans l’état où il se trouve, avec toutes ses aisances et dépendances.
Exiger de l’acquéreur le remboursement du prorata de l’impôt foncier.
Déclarer pour le compte du mandant être à jour des taxes et impôts locaux mis en recouvrement se rapportant au bien et à son usage.
Présenter et justifier tous les diagnostics, rapports immobiliers, certificats et autre pour parvenir à la vente conformément à la législation en vigueur.
Faire toutes déclarations notamment comme le constituant le fait ici sans en justifier et sans que ces déclarations puissent dispenser les tiers d'exiger les justifications nécessaires :
- Qu'il n'existe aucun obstacle à la libre disposition du bien ainsi qu’à sa capacité civile de contracter.
- Qu’il n’est pas, lui-même, ni en état de cessation de paiement, de redressement ou liquidation judiciaire à quelque titre que ce soit, civil ou commercial, ni soumis à de telles procédures.
- Qu’il n’est pas un associé tenu indéfiniment et solidairement du passif social dans une société soumise actuellement à une procédure de redressement ou de liquidation.
- Que son identité complète est celle indiquée aux présentes.
Obliger le constituant à toutes garanties et au rapport de toutes justifications et mainlevées, et de tous certificats de radiation des inscriptions pouvant être révélées par l’état hypothécaire qui sera délivré lors de la publication de la vente.
De toutes sommes reçues, donner quittance, consentir toutes mentions ou subrogations.

IMPOT SUR LA PLUS-VALUE

Cet acte a été publié au service de la publicité foncière de xxxxxxxxxx xxxxxxxxxx Le constituant déclare :
- avoir été averti des conséquences de sa qualité de non résident qu’il revendique sur la taxation des plus-values ;
- dépendre du centre des finances publiques des non-résidents sis 10 rue du Centre à Noisy le Grand (93160).
Exonération de l'impôt sur les plus-values immobilières en vertu de l’article 150 u II 6° du Code général des impôts.
La vente étant réalisée pour un prix non supérieur à 15.000 euros, le constituant bénéficie de l’exonération de l'impôt sur les plus-values.
La vente étant d’un prix inférieur ou égal à cent cinquante mille euros, la dispense de représentant fiscal est automatique.
DOMICILE FISCAL
Pour le contrôle de l’impôt, le constituant déclare être effectivement domicilié à l’adresse susvisée, dépendre actuellement du centre des finances publiques de NOISY LE GRAND CEDEX - 10 RUE DU CENTRE TSA 10010 - 93465 NOISY LE GRAND CEDEX et s’engage à signaler à ce centre tout changement d’adresse.
IMPOT SUR LA MUTATION
Le constituant indique ne pas agir en qualité d'assujetti en tant que tel à la taxe sur la valeur ajoutée au sens de l’article 256 du Code général des impôts.
La vente sera soumise au tarif de droit commun en matière immobilière tel que prévu par l’article 1594D du Code général des impôts.
CONDITIONS ET DÉCLARATIONS GÉNÉRALES
GARANTIE CONTRE LE RISQUE D’EVICTION
Le constituant garantit l'acquéreur contre le risque d’éviction conformément aux dispositions de l’article 1626 du Code civil.
A ce sujet le constituant déclare :
• qu'il n'existe à ce jour aucune action ou litige en cours pouvant porter atteinte au droit de propriété,

Le constituant déclare qu’il n’a pas délivré de congé à un ancien locataire lui permettant d’exercer un droit de préemption.

TERMS AND CONDITIONS
The representative shall execute the following tasks:

Make all declarations, in particular as the grantor does herein, without justifying and without these declarations exempting third parties from requiring necessary justifications:
- That there is no obstacle to the free disposition of the property and to his/her civil capacity to contract.
- That he is not him/herself in a state of suspension of payments, receivership or compulsory liquidation in any capacity whatsoever, whether civil or commercial, nor subject to such procedures.
- That he/she is not a partner jointly and severally liable for the company's liabilities in a company currently under reorganisation or liquidation proceedings.
- That his/her complete identity is as indicated in this power of attorney.
Compel the grantor to provide all warranties and report all justifications and releases, and all deletion certificates of registrations that may be revealed by the mortgage condition to be issued upon publication of this sale.
Issue a receipt for any sums received, and grant any mention or subrogation.
TAX RETURNS
CAPITAL GAINS TAX
The building has become part of the grantor's estate namely:

This deed was published at the real estate registration service of xxxxxxxxxx on xxxxxxxxxx.
The grantor declares
- that he/she has been notified of the consequences of his status as a non-resident which he/she claims upon the taxation of added values;
- that they depend on the non-resident public finance centre located at 10 rue du Centre in Noisy le Grand (93160).
Exemption from tax on capital gains on real estate pursuant to Article 150 u II 6° of the General Tax Code
As the sale is made for a price not exceeding 15,000 euros, the grantor is exempt from capital gains tax.
The sale being of a price lower or equal to one hundred and fifty thousand euros, the exemption of fiscal representative is automatic.
TAX DOMICILE
For tax inspection purposes, the grantor declares that he/she is effectively domiciled at the above address, that he/she currently depends on the NOISY-LE-GRAND public finance centre - 10 rue du Centre TSA 10010 - 93465 NOISY-LE-GRAND and commits to informing this centre of any change of address.
TAX ON TRANSFER
The grantor states that he/she does not act as a taxable person as such for value-added tax purposes within the meaning of Article 256 of the French General Tax Code.
This sale shall be subject to the common law tariff in terms of real estate as provided for by article 1594D of the General Tax Code.
CONDITIONS AND GENERAL DECLARATIONS
GUARANTEE AGAINST THE RISK OF EVICTION
The grantor guarantees the buyer against the risk of being evicted in accordance with the provisions of article 1626 of the French Civil Code.
On this subject the grantor declares:
• that to date there are no outstanding lawsuits or disputes that may affect the right of ownership,
• there has been no trespassing onto the neighbouring property,
• that the PROPERTY is not subject to any work order,
• that he/she has conferred on no one other than the BUYER any right over the PROPERTY that may prevent the sale,
• that he/she assigns his/her rights to the buyer in all his/her rights and actions relating to the PROPERTY
GUARANTEE OF ENTITLEMENT
The grantor declares that no leave has been granted to a former tenant that allows him/her to exercise a right of first refusal.
MORTGAGE GUARANTEE
The grantor complies, if there is one or more registered mortgagees, to settle all the sums still owed to them, to bring back at their own expense the certificates of cancellation of entries, and to justify this to the buyer.
EASEMENTS & RIGHTS OF WAY
The Buyer shall benefit from or bear with the easements or rights of special entitlement, if any.
The grantor declares
• not to have created or allowed to create an easement or right of special entitlement that is not reported herein,
• that, to the best of his/her knowledge, there is none other than those resulting, where appropriate, from the deed, from the natural and environmental location of the place and from urban planning.
STATE OF PROPERTY
The buyer shall have the PROPERTY in the state in which it is to this day, as he/she has seen it and visited it, and the grantor expressly refrains from making any material or legal modifications to it.
