peer agreement (net): +1"PROPRIETORY RIGHTS" Explanation: The Answerer is an Assistant Professor of Law. To translate الحقوق العينية as "RIght in rem" in legal terms is totally incorrect. In fact "Right in rem" is a right that is available against the world at large such as my right that I must not be defamed. This right is available to me where ever I am and is available against the entire population of world. As against this is "Right in Personum" the right that is available against a particular person. My right against the one who has bought my car is available against that very person only. The correct translation of الحقوق العينية in legal terms is "PROPRIETORY RIGHTS" i.e rights concerning one property. As against this is "PERSONAL RIGHTS" i.e rights concerning ones person such as my right of freedom of speach, trade etc. |
