Dutch term

rechtsplegings en uitgavenvergoeding

Dutch to English Law/Patents Law (general)
From a hearing in BELGIUM
Struggling with the fact that it talks about "alle kosten van het geding" (all the costs of the proceedings: IATE), then "rechtsplegingsvergoeding" and "uitgavensvergoeding" as I'm not sure what the difference is, especially between the last two. Slightly confusing discussion on the second term here: https://www.proz.com/kudoz/dutch-to-english/law-patents/2546...

ST:
te horen veroordelen tot alle kosten van het geding, met inbegrip van de kosten van dagvaarding en de rechtsplegings en uitgavenvergoeding, voorzien bij art.

Suggested TT:
ordered to pay all the costs of the proceedings, including the costs of the summons and indemnity for legal proceedings and litigation costs, as provided for in Article

an allowance for assessed costs and 'out-of-pocket' disbursements

I'm including an example sentence with party/party costs quoted in the first ProZ weblink and as a translation of the Belgian French rechtsplegings 'equivalent' of indemnité de procédure. I specifically drew a Belgian lawyer - acting for the Brussels branch of our London translation office on both the Dutch and the French terms. He told me they were 'assessed legal + litigation costs'. Alas, other non-assessment explanations tend to get dreadfully confused.

You are welcome. Any comment I make must be qualified by the point that I hit on the Belgian terms principally in French, but had my arm twisted to edit the Dutch or 'Belgian' - see ProZ's separate category for Flemish - 'equivalents'. It's also 40 years since that nice Belgian lawyer had been shown around our London translation office, but I wouln't use the term of indemnity, as in insurance or third-party procedings - rather an allowance.

Then I'd change your 'costs of the legal proceedings' to 'litigation costs' - previously known to us legal dinosaurs as 'costs *in* the summons' and def. agree with the rest after the comma.
Example sentence:

Party/party costs are costs which the court orders another party to pay, or which another party has agreed to pay, as part of the terms of settlement of a court case. These costs are also known as “ordered costs”.

Note from asker:
Thank you so much for such a thorough explanation! So would you go with "assessed legal and litigation costs" or "an allowance for assessed costs and 'out-of-pocket' disbursements" for "rechtsplegings en uitgavenvergoeding"? Then for "de kosten van het geding, met inbegrip van de rechtsplegingsvergoeding", you'd have "costs of the legal proceedings, including an allowance for assessed costs"?

agree Tina Vonhof (X) : It pertains to legal costs such as the production of documents, baliliff's fees, etc. .

Hartelijk dank, Tina ! Costs before or after the event are a broad concept in litigation. As one QC once quipped: 'I've never understood costs, but I know I have to apply for them.' https://www.gabyhardwicke.co.uk/briefing-notes/costs-in-liti...
agree Cillie Swart : seems plausible

Thanks, Cillie. I received this answer - in both French and Dutch - from the Belgian öawyer's mouth.
