مقدّمة
لمّا كان الفريق الأول يملك أقساما في العقار المبني رقم / / وهو يقوم بتأجيرها، ولمّا كان الفريق الثاني يرغب مجددا بتمديد عقد الإيجار الموقّع بتاريخ / / 20 وتنتهي مدّته بتاريخ / / 20، بنفس الشروط باستثناء المدة.
لذلك، فقد تم الاتفاق بين الفريقين بالرضى والقبول المتبادلين على ما يلي:
المادة الأولى : تعتبر المقدمة جزءاً غير منفصل عن هذا العقد.
المادة الثانية : أ جر الفريق الأول من الفريق الثاني الطوابق والأقسام والمساحات الآتية من العقار / /:
أ- الجزء العلوي من القسـم /16/ (أي الطابق الثالث بكامله ) ومساحته التقريبية حوالي الـ /630/ م2.
ب- القسم /4/ كائن في الطابق السفلي الثاني بمساحة تقريبية /16/ م2.
ج- مساحة /70/ م2 من سطح المبنى حيث توجد التجهيزات وصحون الإلتقاط اللازمة للفريق الثاني في نشاطه وأعماله، بالإضافة إلى آلات التكييف للطابق الثاني ضمن المساحة المذكورة.
المادة الثالثة: اتفق الفريقان على تحديد وجهة استعمال المأجور بجميع أقسامه ومساحاته على الشكل الآتي: مكاتب إعلامية وصحفية وإخبارية ذات الطابعين الإداري والتجاري وعلى وجه العموم كلّ ما يتلاءم مع طبيعة عمل الفريق الثاني ونشاطه أو ما هو ضروري ومتمّم ومكمّل له.
المــادة (1)
يلتزم المرخص له بتحقيق متطلبات جودة الخدمة المنصوص عليها فـي ملحق متطلبات جودة الخدمة (مؤشرات الأداء الرئيسية) المرفق بهذه اللائحة .
المــادة (2)
يلتــــزم المرخص لـــــه بآليــــة قياس مؤشـــــرات الأداء لمتطلبات جـــــودة الخدمــــة التــــي تـصــدر من الرئيس التنفـيذي وتنشر فـي الموقع الاإلكتروني للهيئة، كما يلتزم بالاحتفاظ بالمعلومات
المرتبطة بمؤشرات الأداء فـي سجلات جودة الخدمة لمدة لا تقل عن (6) ستة أشهر .
المــادة (3)
يلتزم المرخص له بتقديم تقارير عن مؤشرات الأداء لمتطلبات جودة الخدمة المنصوص عليها فـي الملحق المرفق بهذه اللائحة خلال مدة لا تجاوز شهرا من انتهاء فترة القياس المحددة .
كمــــا يلتــــزم بنشــر تــلك التقاريــــر فــــي صحيفتـــين محليتين يوميتــــين بالآليـــــة والمواعيـــــد التي تحددها الهيئة .
المــادة (4)
تتولـى الهيــئة مراجعــة التقارير التي يقدمهـــا المرخــص له وتدقيق سجلاته واأنظمتــه، وفقـــا لمتطلبات جودة الخدمة ، وللهيئة الاستعانة باستشاري أو مدقـــق خارجـــي لمراجعـــة وتدقيق البيانـات والتقاريـــر المقدمة من المرخص له ، وذلك بموجب عقد تبرمـــه الهيئــــة مع الاستشاري أو المدقق يتضمن الأجر الذي يتحمله المرخص له ويصرف عن طريق الهيئة .
المادة (5)
مع عدم الإخلال بأي عقوبة منصوص عليها فـي قانون تنظيم الاتصالات أو فـي أي قانون آخر، تفرض الهيئة على المرخص له الغرامات المنصوص عليها فـي ملحق متطلبات جودة الخدمة (مؤشرات الأداء الرئيسية) المرفق بهذه اللائحة، فـي أي من الحالتين الآتيتين :
أ- إذا فشل المرخص له فـي تحقيق متطلبات جودة الخدمة لأسباب غير مبررة .
ب - إذا قـــدم المرخــــص لــــه تقاريــــر مخالفـــــة لآليــــة قيــــاس مؤشرات الاأداء المنصوص عليهــــا فـي المـــادة (2)
من هذه اللائحة .
ترجمة - أنجليزي LEASE CONTRACT
in accordance with Provisions of Law No.( / )
Made BY AND BETWEEN the undersigned two Parties:
Lessor: ________, Commercial Register No.( ), represented by its Chairman of the Board of Directors and Director General Mr. ________, resides in a selected domicile for the purposes of this contract at the following address: ______ Building, ______ Street, _______.
First Party
Lessee: ________ Company, _______ Nationality, represented by its General Manager Mrs. ________, resides in a selected domicile in the leased for all purposes related to this Contract.
Second Party
Preamble
WHEREAS, the First Party owns sections in the built property No./____ / and it leases these sections.
Whereas the Second Party desires again to extend the Lease Contract dated / /20 commencing on / /20 and ending on / /20 , under the same conditions except for the term.
Therefore, it is agreed between the two parties by mutual consent as follows:
Article (1)
The abovementioned preamble shall be deemed as an integral part of this Contract.
Article (2)
The First Party leased from the Second Party the following floors, sections and areas of the property / /:
a) a) The upper part of section/16/ (the whole third floor) and its approximate area is /630/m2.
b) b) Section /4/ in the lower second floor with an approximate area of /160/m2.
c) c) Area of /70/m2 of the building roof where the fixtures and satellites necessary to the Second Party's activities and works, in addition to the air conditioners for the second floor within the aforementioned area.
Article (3)
The two parties agreed to determine the way of using the leased with all its sections and areas as follows: media, press and news offices of an administrative and commercial nature and generally all which is consistent with the Second Party's work nature and its activity or with whatsoever is necessary, integral and complementary to it.
Regulations of Service Quality Requirements which Licensee shall provide
Article (1)
The licensee shall comply with achieving the Requirements of Service Quality set out in the annex of Service Quality Requirements (key performance indicators) attached hereto.
Article (2)
The licensee shall comply with the mechanism of KPIs of the Service Quality Requirements issued by the CEO which shall be published on the website of the Authority, in addition he shall keep information related to performance indicators in the records of service quality for a period not less than (6) six months.
Article (3)
The licensee shall provide reports regarding key performance indicators of the Service Quality Requirements set out in the annex attached hereto within a period not exceeding one month as of the end of the determined measurement period.
In addition, the licensee shall publish such reports in two daily local newspapers according to the mechanism and times determined by the Authority.
Article (4)
The Authority shall revise reports provided by the licensee, check its records and systems, according to Requirements of Service Quality, and the Authority may solicit the assistance of a consultant or an external auditor to revise and audit data and reports provided by the licensee, and that is under a contract made between the Authority and the consultant or the auditor including the compensation which the licensee shall bear and shall be released by the Authority.
Article (5)
Without prejudice to any penalty set out in the law of communications regulation or in any other law, the Authority shall impose on the licensee the penalties set out in the annex of Requirements of Service Quality (key performance indicators) attached hereto, in any of the following two cases:
a) If the licensee failed to achieve Service Quality Requirements for unjustified reasons.
b) If the licensee provided reports which contradict the mechanism of measuring performance indicators set out in Article (2) herein.
