الملخص
يقوم هذا البحث على دراسة المحكّم بشكل خاص في عقد التحكيم في الفقه الإسلامي دراسة: "فقهية تحليلية"، ومن أبرز عناصرها: بيان من هو المحكّم في عقد التحكيم ، و تعريف التحكيم والمسئولية المترتبة على المحكّم ومتى يضمن المحكّم ومتى لا يضمن.
وتقوم أيضا هذه الدراسة على تحقيق مجموعة من الأهداف: كتحديد التزامات ومسؤوليات المحكّم وتحديد الأسس الحاكمة لضمان المحكّم.
ويضيف هذا البحث قياس المحكّم على الطبيب في أسس الضمان ذلك أن كليهما يتعاملان مع إحدى الضرورات الخمس فالمحكّم يتعامل مع المال أو الكيان الأسري والطبيب يتعامل مع النفس البشرية .
وأهم نتائج الدراسة بينت أن نتائج عمل المحكّم في عقد التحكيم تشكل ضرورة شرعية حفظا للحقوق المادية للناس أو كيان الأسرة من التبدد و الضياع والتأكيد على وجود المحاسبة عند تجاوز المحكّم صلاحيته.
وأما أهم التوصيات التي خرج بها هذا البحث هي ضرورة تفعيل مرجعية المحاسبة للمحكّم في عقد التحكيم خاصة في القضايا الأسرية لأن فيها حقوق مادية ومعنوية في استمرار الكيان الأسري من عدمه.

Summary
This research is based on the study of the arbitrator in particular in the arbitration contract in Islamic jurisprudence, a study: “analytical jurisprudence”, and the most prominent of its elements: a statement who is the arbitrator in the arbitration contract, the definition of arbitration and the responsibility of the arbitrator and when to guarantee the arbitrator and when not to guarantee
This study is also based on achieving a set of objectives: such as defining the obligations and responsibilities of the arbitrator and determining the rules governing the arbitrator's guarantee
This research adds the arbitrator’s analogy to the doctor in the foundations of insurance, because both deal with one of the five necessities. The arbitrator deals with money or the family entity, and the doctor deals with the human soul.
The most important results of the study showed that the results of the arbitrator’s work in the arbitration contract constitute a legitimate necessity in order to preserve the material rights of people or the family entity from dissipation and loss, and to emphasize the existence of accountability when the arbitrator exceeds his authority.
The most important recommendations that came out of this research is the necessity of activating the accountability reference for the arbitrator in the arbitration contract, especially in family cases, because it has material and moral rights in the continuation of the family entity or not.
