من المقرر ابتداء أن الإسلام قصد تحقيق مقاصد المكلفين أو منافعهم في العاجل والآجل، فجاء بحفظ الضروريات الخمس التي لا ينازع في وجوب حفظها أحد؛ إذ لا تتصور الحياة بدونها، وهي: الدين، والنفس، والعقل، والنسل، والمال. ثم إن هذه الضروريات على أهميتها ليست على درجة واحدة من الأهمية في حال حصل التعارض بينها، فيقدم الأهم منها على غيره ، ومعلوم أن الدين في الرتبة الأولى من حيث الأهمية والمكانة؛ولذلك تبذل المال مع كونه ضروريا من أجل حفظ الدين وسلامته، كما تبذل النفوس مع ضرورة حفظها وأهميتها من أجل حفظ الدين عند التعارض وعدم إمكان التوفيق والجمع بينهما، وذلك في حال اعتداء العدو على ديار المسلمين ، والمقصود من الجهاد " هو كسر شوكة الكفر، وإعزاز الدين، وسلامة ديار المسلمين "( ) ، وعليه فإن سلامة الديار تعتبر حفظا للدين من جهة العدم ، فتبذل الأموال والنفوس من اجل المحافظة على البلد الذي يسكنه الإنسان ، فيفتدى بالمهج والأرواح ، ومن قتل في سبيل ذلك قتل شهيدا ، ومما سيتضح معنا في المطلب التالي من نصوص الفقهاء الذين ينصون صراحة على أن حفظ الأوطان إنما هو واجب متعين في عنق أهله وساكنيه أوضح دليل على أن انتماء الإنسان لوطنه الذي ولد فوق ترابه ونشأ بين أحيائه و أرجائه مفهوم أصيل من صلب هذا الدين الذي نؤمن به ، وليس مفهوما غريبا عنه.

It's already determined that Islam's intention is the benefit of responsible Muslims sooner or later, therefore it specified the preservation of the five necessities that no one can question, for life is not a life without them, these necessities are: religion, soul, mind, offspring and money. They are not all in the same level of importance in case there occurred to be a variance among them; in that case the most important comes first. Religion usually comes first due to its distinction, on account of that money is sacrificed –despite of its necessity- for the preservation of religion, so is the soul when it becomes difficult to preserve both, in the case of enemies attack on Islamic countries. The purpose of Jihad is to destroy the force of infidelity, the implantation of religion and the safety of Islamic countries . Therefore their safety is considered a preservation of religion, and for that purpose money and souls are sacrificed, and anyone killed in such condition is a martyr. The next requirement will state what jurisprudents have declared clearly that the preservation of one's country in nothing but an obligation to them, which demonstrates that a person's loyalty for their country is a genuine concept related strongly to Islam, not different from it.

ترجمة - أنجليزي • The liberal theory has criticized the two principles of sovereignty and non-intervention. It does not consider sovereignty an absolute good, however, its significance lies in protecting the people from dictatorship and from external intervention in internal affairs, and a state claiming sovereignty is worth respect as long as it protects the human rights of its citizens, from whom rights the state draws its sovereignty. When a state violates the human rights of its citizens it can no longer demand full sovereignty, for in certain circumstances the moral good of sovereignty should submit to more sublime necessities concerning humanity as long as the establishment of justice for individuals and societies within the state is more important than formal system and stability. Intervention, hence, is necessary being a mean of preventing chaos in a world threatened by internal conflicts and violence to extend beyond borders, in order to maintain the regional and global security. This kind of humanitarian intervention is supported by liberalism which considers it a challenge for the sovereignty of the state that violates human rights illegitimately within a global society.
