There is a kind of pear which will be ordered before it is ripe and sold as far as overseas. When it is ripe, people will often see that the pear falling to the ground turns into “water”. It will not occur in most pear orchards in the inland, which only can be seen on the riverside of Peacock River. On the beautiful riverside of Peacock River, a gust of wind blows across and then a strong and unique aroma passing will attract bees to dance, make orchardists intoxicated and tourists enjoy themselves. All these are resulted from the local bergamot pear – Korla bergamot pear.
If people want to know about the authentic Korla bergamot pear, they should start from the legend of Peacock River. Once upon a time, there was a beautiful princess in the ancient Yanqi country. She was in low spirits day and night, but no one knew the reason for this. The son of a minister, Tahir, who fell in love with her secretly, noticed it and worried deeply in his heart. One day, the princess had a dream that she tasted a kind of bergamot pear she had never tried, and suddenly she became happy again and started to find the long-lost happiness. Thus, she told the king she wanted this pear tree, and the king immediately issued a reward for the person to find the tree. Tahir knew it was a chance, so he traveled a long and dangerous way, fighting fowls and beasts, and finally he found this kind of pear tree and transplanted it back after 3 months’ searching. The princess turned out to be quite happy when she saw it and took care of the tree together with Tahir. Therefore, they fell in love with each other. But when they were preparing for their wedding, the chief of the country where this pear tree belonged sent some people and killed Tahir and threw Tahir’s body in the river near the kingdom. When the princess knew the news, she was overwhelmed with sorrow, so finally she decisively jumped into the river to kill herself after watering the pear tree for the last time. In the instant she threw herself into the river, two graceful peacocks flied towards the sky side by side, so people name this river as Peacock River.
With regard to the origin of Korla pear itself, there is a more plaintive and graceful legend. According to the legend, there was a clever and beautiful girl named Elliman in Korla. In order to provide a chance for the fellow countrymen on the edge of the desert to eat pear, she was fearless of danger and difficulty, and made an arduous journey to find excellent pear trees, with the journey from the sea in the east to South Country in the west, which was lasted for three full years. And finally she found an excellent variety, so she grafted these pear trees with local wild pear, and only one tree was grafted successfully. Under her tender care, the pear tree bloomed and bore fruits, which gave out aroma, and the pear tasted sweet and tasty, so people gladly called it “Korla pear”. When the news reached to the local landlord, he wanted to impropriate this pear tree, but the requirement was refused by the girl. In great anger, the landlord killed the girl brutally and cut down the pear tree. However, in the spring of the next year, the pear tree magically grew tender shoots, bloomed and bore fruits. People said it was because the spirit of the girl, so they transplanted the pear tree and grew it widely. Since then, it was the inception of Korla bergamot pear.
While a legend is still a legend, and there is no historical records to refer to. The history of Korla bergamot pear actually can be traced back to the Han and Tang Dynasty. In all ages, it is accepted and loved by the people universally for its excellent variety and unique sweetness as well as its sad and touching legend. Even though it is of small size, Korla bergamot pear is a “big shot” which won big prizes all over the world. In the French World Exposition in 1920s, Korla bergamot pear was achieved the silver prize among the 1432 kinds of pear on the Exposition, only second to the French white pear, and was honored as the “queen of world’s pear”. Since the establishment of the People’s Republic of China, Korla bergamot pear has won championships for several times in the national fruits competition; in 1957, it was ranked number one in the national pear production meeting; in 1985, it was classified as national high quality fruit; in 1999, in Kunming World Horticultural Exposition, Korla bergamot pear won gold award. Since getting into the international market in 1987, Korla bergamot pear has been sold well on the market. In September, 1986, Queen of the U.K. Elizabeth ate Korla bergamot pear and presented her thanks to the Chinese people for such a good pear. Since then, Korla bergamot pear has been known as high quality fruit to entertain distinguished guests.

The last version had been written and issued to country teams more than two years back. This version has incorporated changes in policies and procedures since then.
1.1 Purpose of the document
The purpose of the Minimum Control Standards is to achieve the following:
1. Define the mandatory minimum control standards MCS for a branch to adhere to for minimizing operational risk.
2. Help the country to assess its current state of operation against the standards and to take actions where deemed necessary to comply.
3. Country teams should use these standards along with the local regulatory requirements and the Manual of Personal and Business Protection MPBPand build Branch Operations Manual for branches to adopt and demonstrate compliance.
1.2 Context & Roadmap
The minimum control standards cover the following areas:
1. Services Process that covers Cash Handling and Transactions, Cheque Deposit, Cheque Clearing, Fund Transfer and Drafts, Account Opening and Maintenance
2. Specific Banking Service, Instrument or Order such as covers Safe Deposit Lockers, General Security Stationery, Travellers’ Cheques, Prohibitory / Attachment Order.
3. Branch Security that covers Branch Premises Security, Business Contingency Plan, Security Incident and Emergency Procedures, Prime Keys / Combination Lock including ATM, Information System Security.
4. Supporting Policies and Procedures such as Account and Reconciliation, Anti‐Money Laundering and Terrorist Financing, Outsourced Activities, Group and Country Regulatory Compliance.
5. Management Assurance procedures such as Management Control, Staff Training and Development.
These standards do not cover the governance and controls related to sales and selling activity in the branches as these are governed by the respective segment and product policies.
Section 1: Branch Premises
Branch Security
The primary responsibility of ensuring that the branch security infrastructure and security equipment are in place is with the country security team. The Integrated Distribution Team’s responsibility is on the day to day operations management of the areas and activities in their direct control.
Restricted Access to Sensitive Areas
2.1.1 Every branch premises must have an effective access control system e.g. Magnetic swipe cards or mechanical digital locks or electronically controlled doors opened by cards etc such that unauthorised people cannot gain access to sensitive areas.
2.1.2 Physical systems and procedures must be established to facilitate routine access to Bank premises for authorized staff, contractors and visitors and prevent unauthorized entry by members of the public.
2.1.3 All staff and / or Contractors must wear the identity cards / badges when working in the branch premises.
2.1.4 Visitors and contractors must not be permitted free access throughout the Branch premises.
2.1.5 Visitors must be requested to produce identity cards. A record of all visitors including maintenance staff must be maintained. This must include full details of the visitor, including identity card number where applicable , person being visited, time of entry and exit and reason for the visit. This is not required for customers visiting the branch for normal banking services.
2.1.6 Only Bank staff and contractors including cleaners who have been authorised will be allowed to enter the support zone / back office area without an escort. All other visitors must be escorted by a member of the Bank’s staff.
2.1.7 Access to cashier rooms, cash vaults and book rooms must be restricted to staff working within these areas. In the case of safe deposit vaults, customers are also permitted access.
2.1.8 Entry to computer and communications rooms must be controlled by an automated control of access system. Doors to these rooms must be self‐closing and must be kept locked.
2.1.9 Only staff directly involved in the running and maintenance of the equipment should be able to have unrestricted access to computer and communications rooms.
2.1.10 All visitors to computer and communications rooms must be logged in a book maintained for this purpose. Visits by management, contractors, auditors and all other persons not having standing authority to enter the room must be recorded. In addition to recording the details of the visitor and the time of entry and exit, the log entry should show the reason for the visit
2.2 CCTVs or Surveillance Cameras
2.2.1 Surveillance Cameras or Closed Circuit TV Cameras CCTV System must be installed at an optimal position e.g. capturing customer face covering cash area e.g. Teller Counter, Safe , ATM and any other critical areas as specified by country CRES, country Security team or as decided by country distribution team.
2.2.2 Cameras should not look through glass as reflections will mar the picture.
2.2.3 To achieve optimum performance, the following procedures should be followed by officers responsible for CCTV systems:
i. They should be checked daily to ensure that the pictures received from each camera are clear and sharp and recording devices are operational.
ii. Sufficient storage capacity should be provided to allow images to be saved for a minimum of 28 days. This period should be extended where this is required by local regulations legislation or business needs. Hard disk recording of images is the preferred medium of image storage and should be used wherever possible.
2.2.4 Video tape records where used must be securely stored in fire‐resistant cabinet
2.2.5 A record of testing, maintenance, breakdowns and actions taken must be maintained by a branch officer.

AMO & Partners is Saudi owned Engineering Service Company involved in inspection & testing of welded equipment. Our work necessitates use of Industrial radiography by utilizing sealed gamma source of Ir 192 & Co 60.
Industrial radiography provides a powerful set of inspection tool for a wide variety of materials. The utilization of ionizing radiation allows objects to be scrutinized in depth. Radiographic testing processes involve the use of gamma ray emitting materials to produce highly detailed film images for inspection. The advantages to radiography includes: inspection of a wide variety of material types with varying density, ability to inspect assembled components, minimum surface preparation required, sensitivity to changes in thickness corrosion, voids, cracks and material density changes, the ability to detect both surface and subsurface defects and the ability to provide a permanent record of the inspection.
The benefits of employing industrial radiography in crucial testing environments are numerous while the risks involved for personnel require careful consideration. The acts of minimizing risk and promoting calculated safety measures ensure that radiographers are protected from harmful exposure to radiation.
Industrial radiography presents our customers with immense benefits such as highly detailed reliable images, cost-effective inspections. Maintaining a strong focus on safety and associated best practices helps all those involved.
Industrial radiography applications that benefit from gamma radiation are most commonly seen in testing welds, machined parts, plate metal, pipe wall, structural & casting materials. Because of the portable nature of gamma sources, testing may be conducted in both on-site and field operations. Common isotopes used for welding inspection in industry include Iridium-192 and Cobalt-60.
OPTIMIZATION OF PROTECTION (ALARA)
AMO management is committed to eliminate unnecessary exposure & reduce the dose to the ALARA level.
The ALARA principle is applicable even when the potential dose is well below the individual dose limit because it is assumed that some risk may be associated with any dose of radiation, no matter how small. ALARA also means balancing the benefits of dose reduction against industrial needs and economic considerations.
Any unnecessary radiation dose is unacceptable and all people who are associated with radiography shall work in a manner that limits radiation exposure to themselves and to others. Every reasonable & achievable means to reduce radiation exposure shall be taken. Under no circumstances, urgency to complete a task should be justification for not taking reasonable measures to reduce radiation dose. All radiography work shall be optimized in order to avoid unnecessary exposure to radiation.
AMO management shall implement & achieve ALARA principal by:
• Maintaining direct control of radioactive source at all times,
• Adequate training,
• Regular surveys of work areas,
• Safe & secure storage of Radiography sources
• Good engineering & administration controls
• Safe operation & transport of Radioactive sources
• Monitoring of occupational radiation exposures
• Investigations of all exposures that exceed predetermined limits
• Audits of the program by the Radiation Safety Officers
The RSO shall provide training, consultation and other services to Radiographers to assist them in controlling radiation sources and reducing radiation exposure levels.
INDIVIDUAL DOSE AND RISK LIMITS
Dose limits are intended to limit the individual's lifetime risk of stochastic effects from small chronic exposures as well as to prevent non-stochastic effects from large doses. For individuals who are exposed to ionizing radiation as a direct result of their employment, individual dose limits are based on the philosophy that their total health risks should be no greater than the risks accepted by workers in comparable occupations or industries who are not exposed to radiation. More detail about dose limits are specified in Paragraph G.
E. AMO RADIATION PROTECTION POLICY
AMO recognizes importance of radiation protection and considers safety as an integral part of its business strategy. AMO seeks to achieve high degree of safety awareness and commitment among its employees through communication, training, and development.
AMO will comply with all safety requirements of regulatory and competent authority and customer. AMO will focus on protection & safety of its employees and public during performance of all Radiographic activities.
AMO is committed to keep the radiation exposure level “As Low As Reasonably Achievable” by utilizing engineering & administration controls and fostering safety culture during its operations.
AMO will utilize principal of defense in depth & good engineering practice in all aspects of radiation protection.
F. PERSONNEL RESPONSIBILITY, TRAINING AND QUALIFICATION
AMO personnel who have influence on Radiographic activities are described herewith:
• Operation Manager
• Radiation Safety Officers (RSO) – Principal & Assistant
• Radiographers & their assistant
F.1. OPERATION MANAGER
The operation manager has overall responsibility & final authority in all matters related to radiography & radiation safety. As defined by KACST, Operation Manager is the “Director of Facility” and has the ultimate authority in all matters dealing with Radiation Protection. In the performance of his duty, Radiation Safety Officers directly assist him.
The minimum qualification for operation manager is engineering degree & adequate management training for safety in industrial radiography.

ومبدأ "أحميت" قابل للتطبيق حتى عندما تكون الجرعة المحتملة أقل بكثير من حد الجرعة الشخصية لأنه من المفترض أن هناك قدر من المخاطرة ينتج عن أي جرعة من الإشعاع مهما كان صغرها. كما يعني مبدأ "أحميت" أيضًا الموازنة بين فوائد تقليل الجرعة والحاجات الصناعية والاعتبارات الاقتصادية.

ويجب على مسئول الأمان اِلإشعاعي تدريب فنيي التصوير الإشعاعي وتقديم استشارات لهم وغيرها من الخدمات لمساعدتهم في التحكم في مصادر الإشعاع وتقليل مستويات التعرض له.
الجرعة الشخصية وحدود المخاطرة
الهدف من وضع حدود للجرعة هو الحد من تعرض الشخص لمخاطرة حدوث آثار عشوائية مدى الحياة بسبب حالات التعرض البسيطة المستمرة، وكذلك منع التأثيرات غير العشوائية الناتجة من الجرعات الكبيرة. وبالنسبة للأفراد المعرضين للإشعاع المؤين كنتيجة مباشرة لعملهم فإن حدود الجرعة الشخصية تتوقف على الفلسفة التي تقول بأن إجمالي المخاطر الصحية لا ينبغي أن يزيد عن المخاطر التي يتقبلها العاملون في المهن أو الصناعات المماثلة الذين لا يتعرضون للإشعاع. وتحتوي الفقرة (ز ) على المزيد من التفاصيل حول حدود الجرعة.

COMMERCIAL LITERATURE
7.1 Commercial literature provided by ***** such as brochures, leaflets or alike in respect of any Service to be rendered shall have no binding effect between the Customer and *****. Manufacturer’s Manuals are not considered commercial literature for the purpose of this Agreement.
Article 8
WARRANTY
8.1 Any ***** manufactured material supplied under this agreement is warranted to be free from defect in material and manufacture for a period of twelve months from date of replacement provided the site is under ***** maintenance and *****’s obligation under this warranty is limited to repairing or replacing the defective part at its sole discretion.
8.2 Labor is warranted (to have been properly performed) for a period of 90 days from completion and *****’s obligation under this warranty is limited to correcting any improperly performed labor.
8.3 Non-***** equipment and/or parts shall have such warranties as are provided to ***** by the respective manufacturer.
Article 9
TERMS AND TERMINATION
9.1 Term of Agreement. This Agreement shall become effective on the Effective Date and shall continue in full force and effect through the expiration of the term set forth on Exhibit A hereto ( the “Term”), unless sooner terminated by mutual written consent or by either of the Parties pursuant to Article 9.2 and/or 9.3 hereof.
9.2 Termination. Either Party may terminate this Agreement after giving written notice to the other Party in the event:
(a) Material Breach. Of a material breach or material default under this Agreement by the breaching Party; provided, however, that if such material breach or default is subject to cure, the breaching Party shall have a period of fifteen (15) working days following notice by the invoking Party of such breach or default in which to cure the breach or default. If the breach or default is cured within such period to the reasonable satisfaction of the invoking Party, this Agreement shall continue in full force and effect.
(b) ***** may terminate this Agreement with 30 days prior written notice in the event Customer is no longer in charge of the Equipment and/ or the procurement of Services due to, including but not limited to, transfer of ownership of the Equipment or alike.
9.3 ***** may, with immediate effect, terminate this Agreement:
(a) In the event that the Customer executes or causes a third party other than ***** to execute any intervention on the Equipment.
(b) Termination of Existence. This Agreement shall terminate immediately if either Party ceases to exist or commences proceedings for its liquidation, insolvency or reorganization.
Article 10
EFFECTS OF TERMINATION
10.1 Liability for Termination. Neither Party shall have any liability to the other Party solely as a result of termination in accordance with Article 9.2 and/ or 9.3 hereof or for non-renewal of this Agreement. Termination of this Agreement for any reason shall not relieve any Party for any liability or obligation, which may have arisen hereunder prior to such termination.
10.2 Payments of Amounts Due. Upon termination of this Agreement by either Party in accordance with Article 9.2 and/ or 9.3 hereof or otherwise, all amounts due by the Customer pursuant to this Agreement and unpaid shall accrue and become immediately due and payable to *****.
Article 11
FORCE MAJEURE
11.1 Force majeure events: Neither Party shall be responsible for total or partial non-performance due to circumstances beyond its reasonable control, including, without limitation, Acts of God, accidents, compliance with any law, regulation or other government order (whether or not valid), war or national emergency, riots, fire, industrial action, shortages of labour, restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials.
11.2 Notification and termination: The Party invoking any such events shall promptly notify the other Party, giving an estimate as to the foreseeable duration thereof. Should the event last for a continuous period in excess of 3 (three) months, either Party shall be entitled to terminate the affected order or the Agreement in accordance with Article 9.2.
Article 12
CONFIDENTIALITY
12.1 Duty of confidentiality: Customer shall not disclose or use for purposes outside the scope of this Agreement any information made available to it by ***** in whatever form maintained and irrespective of the form of communication ("Confidential Information"). Customer will obtain of each of its affiliates, associated companies, employees, officers, agents, representatives and any other persons or entities that, by reason of this Agreement, may come into possession of Confidential Information, their pledge not disclose such information.
12.2 Protection of Confidential Information: For the purpose of protecting Confidential Information Customer shall use efforts commensurate with those it employs for the protection of corresponding information of its own (but in no case less than reasonable care) and, in particular, shall procure that such information is stored securely and is not freely accessible.
Article 13
GOVERNING LAW AND DISPUTE RESOLUTION
13.1 Governing Law. This Agreement shall be interpreted, construed and enforced in accordance with the laws and regulations of Dubai, U.A.E.
13.2 Jurisdiction: All disputes, controversies or differences arising between Parties out of or connection with this Agreement, shall be settled first by mutual discussion and, only if that is unavailing, Parties shall submit to the exclusive jurisdiction of the Courts of Dubai, U.A.E. .
Article 14
LIMITATION OF LIABILITY
14.1 Liability: No liability whatsoever for direct damages shall attach to ***** until the Service have been paid for in full and, then said liability shall not exceed the maximum annual Service Fees charged by ***** for the Services rendered to the Equipment under this Agreement, excluding VAT.
14.2 ***** shall be under no liability for any damage to the Equipment caused by the operation of the Equipment outside the Equipment’s designed use and conditions of use.
14.3 ***** shall be under no liability to Customer for any indirect or consequential damage resulting from delay, trading loss or damage, or for any other indirect or consequential damage, including but not limited to crane/rigging, refrigeration or any other collateral damage.
Article 15
MISCELLANEOUS
15.1 Notice. Any notice, consent, request, instruction, approval or other communication required or permitted under this Agreement or any other document or instrument delivered in connection herewith shall be deemed to have been validly given, made or served if in writing and delivered by hand, or transmitted by facsimile, or mailed by certified mail, return receipt requested, postage prepaid and properly addressed, or sent by express courier service, to the respective Party to whom such notice, consent, request, instruction, approval or other communication relates at the following address or facsimile number:

8-1 تتمتع أي مواد تقوم شركة ***** بتصنيعها وتقديمها وفقاً لهذه الاتفاقية بضمان الخلو من عيوب الخامات والتصنيع لمدة اثنى عشر شهراً من تاريخ الاستبدال بشرط أن تكون ***** هي المسؤولة عن صيانة الموقع، ويكون الالتزام الواقع على عاتق ***** بموجب هذا الضمان قاصراً على إصلاح أو استبدال الجزء المعيب وفقاً لما تراه مناسباً.
8-2 للعمل ضمان (بتأديته كما يجب) يمتد لمدة 90 يوماً من تاريخ الانتهاء، ويقتصر الالتزام الواقع على عاتق شركة ***** بموجب هذا الضمان على تصحيح أيّ أعمال لم يتم تأديتها كما يجب.
8-3 يكون للمعدات والأجزاء - أو كلاهما - التي قامت بتصنيعها شركات أخرى غير ***** الضمانات التي تقدمها تلك الشركات لشركة *****.
البند التاسع
مدة الاتفاقية وإنهاؤها
9-1 مدة الاتفاقية: تكون هذه الاتفاقية نافذة في تاريخ النفاذ وتظل بكامل الأثر والنفاذ حتى انتهاء مدتها المنصوص عليها في الشكل أ في هذه الاتفاقية ("المدة") ما لم يتم إنهاؤها قبل ذلك من خلال موافقة كتابية من الطرفين أو على يد أحد الطرفين بموجب البند رقم 9.2 أو 9.3 في هذه الاتفاقية أو كلاهما.
9-2 الإنهاء: يجوز لأيٍ من الطرفين إنهاء هذه الاتفاقية بعد إرسال إخطار كتابيّ للطرف الآخر في حال:
(أ) الإخلال الجوهريّ: عند حدوث إخلال أو تقصير جوهريّ بهذه الاتفاقية من قِبَل أحد الطرفين - بشرط أن يكون ذلك الإخلال أو التقصير الجوهريّ قابلاً للإصلاح - يكون أمام الطرف المُخِلّ خمسة عشر (15) يوم عمل عقب تلقي إخطار من الطرف المُحْتَج على الإخلال أو التقصير يقوم خلالها بإصلاح هذا الإخلال أو التقصير، فإذا تم إصلاح الإخلال أو التقصير خلال هذه الفترة على النحو الذي يُرضي الطرف المُحْتَج تظل هذه الاتفاقية بكامل الأثر والنفاذ.
(ب) يجوز لشركة ***** إنهاء هذه الاتفاقية بعد إرسال إخطار خطي مسبق مدته 30 يوماً في حال لم يعد العميل مسؤولاً عن المعدات أو شراء الخدمات أو كلاهما لأسباب تشمل دون أن تقتصر على نقل ملكية المعدات أو ما شابه ذلك.
9-3 يجوز لشركة ***** إنهاء هذه الاتفاقية بأثرٍ فوريّ:
(أ) في حال قيام العميل بالتدخل في المعدات أو تسبب في تدخل طرف آخر غير ***** فيها.
(ب) إنهاء وجود الاتفاقية: تنتهي هذه الاتفاقية على الفور في حال لم يعد أحد الطرفين موجوداً أو بدأ في إجراءات التصفية أو الإعسار أو إعادة التنظيم.
البند العاشر
الآثار المترتبة على الإنهاء
10-1 مسؤولية الإنهاء: لا يكون أياً من الطرفين مسؤولاً أمام الطرف الآخر فقط نتيجة إنهاء الاتفاقية وفقاً للبند رقم 9.2 أو رقم 9.3 من هذه الاتفاقية أو كلاهما أو مسؤولاً عن عدم تجديد هذه الاتفاقية، ولا يُعْفِي إنهاء هذه الاتفاقية لأي سببٍ من الأسباب أياً من الطرفين من أيّ مسؤولية أو التزام قد يكون نشأ بموجبها قبل إنهائها.
10-2 المدفوعات والمبالغ المستحقة: عقب إنهاء هذه الاتفاقية من قبل أحد الطرفين وفقاً للبند 9.2 أو 9.3 من هذه الاتفاقية أو كلاهما أو غير ذلك تكون جميع المبالغ المستحقة على العميل بموجب الاتفاقية التي لم يَقُم بسدادها مستحقة الدفع فوراً لشركة *****.
البند الحادي عشر
القوة القاهرة
11-1 أحداث القوة القاهرة: لا يكون أياً من الطرفين مسؤولاً عن عدم الأداء الكليّ أو الجزئيّ بسبب ظروف خارجة عن سيطرته المعقولة بما في ذلك دون أن يقتصر على القضاء والقدر، والحوادث، والالتزام بأي قانون أو لائحة أو قرار حكوميّ آخر (سواء كان سارياً أو غير ساري)، والحرب أو الطوارئ على المستوى الوطنيّ، وأعمال الشغب، والحرائق، والحوادث الصناعية، وحالات نقص العمالة، والقيود أو حالات التأخير التي تؤثر في شركات النقل أو عدم القدرة على الحصول على توريدات كافية أو مناسبة من الخامات أو تَأَخُّر ذلك.
11-2 الإخطار والإنهاء: على الطرف المُحْتَج على أيٍ من هذه الأحداث أن يُخْطِر على الفور الطرف الآخر مع تقديم تقدير للمدة المتوقعة لهذا الإخطار، وفي حال استمرار الحدث لفترة متصلة تزيد على 3 (ثلاثة) أشهر يحق لأيٍ من الطرفين إنهاء القرار موضع الضرر أو الاتفاقية وفقاً للبند 9.2.
البند الثاني عشر
الحفاظ على السرية
12-1 الالتزام بالسرية: على العميل عدم إفشاء أية معلومات تقدمها له شركة ***** في أي شكل يتم الاحتفاظ بها بغض النظر عن شكل الاتصال ("معلومات سرية") أو استخدامها لأغراض تتجاوز هذه الاتفاقية، ويحصل العميل على تعهد من كل من الشركات التابعة له، والشركات المرتبطة به، وموظفيه، ومكاتبه، ووكلائه، وممثليه، وأي أشخاص آخرين أو هيئات أخرى قد تحصل بموجب هذه الاتفاقية على معلومات سرية - بعدم إفشاء تلك المعلومات.
12-2 الحفاظ على سرية المعلومات: فيما يتعلق بغرض الحفاظ على سرية المعلومات يبذل العميل جهوداً تتناسب مع تلك الجهود التي يبذلها للحفاظ على المعلومات المناظرة الخاصة به (ولكن ليس أقل من مستوى العناية المعقول)، وعليه على وجه الخصوص توفير ما يلزم لتخزين تلك المعلومات بسرية بحيث لا يُسمح بالوصول إليها بدون إذن.
البند الثالث عشر
القوانين المعمول بها وفض النزاعات
13-1 القوانين المعمول بها: يتم تفسير هذه الاتفاقية وتأويلها وتنفيذها وفقاً لقوانين ولوائح إمارة دبيّ في دولة الإمارات العربية المتحدة.
13-2 الاختصاص القضائيّ: يتم تسوية جميع النزاعات، أو الخلافات، أو الاختلافات التي تنشأ بين الطرفين بسبب هذه الاتفاقية أو فيما يتعلق بها من خلال النقاش المشترك أولاً وفي حال لم يكن لذلك جدوى يخضع الطرفان للاختصاص الحصريّ لمحاكم إمارة دبيّ في دولة الإمارات العربية المتحدة.
البند الرابع عشر
حدود المسؤولية
14-1 المسؤولية: لا تتحمل شركة ***** أية مسؤولية تُذكر عن الأضرار المباشرة حتى سداد رسوم الخدمة كاملةً، ولا تتجاوز المسؤولية المذكورة الحد الأقصى للرسوم السنوية للخدمة التي تتقاضاها ***** عن الخدمات التي تقدمها للمعدات بموجب هذه الاتفاقية ويُثتثنى من ذلك ضريبة القيمة المضافة.
14-2 لا تكون شركة ***** مسؤولة عن أية أضرار للمعدات تنتج عن استخدام تلك المعدات في استخدامات أخرى غير الاستخدامات والظروف التي صُممت من أجلها.
14-3 لا تكون شركة ***** مسؤولة أمام العميل عن أي ضرر غير مباشر أو تالي ينتج عن التأخير، أو الخسائر التجارية، أو الأضرار، ولا عن أية أضرار أخرى غير مباشرة أو تالية بما في ذلك دون أن يقتصر على تجهيزات الروافع، أو التبريد، أو أي أضرار أخرى.

15-1 الإخطار: أي إخطار أو موافقة أو طلب أو تعليمات أو أي مراسلات أخرى مطلوبة أو مسموح بها بموجب هذه الاتفاقية أو أي وثيقة أو مستند آخر ويتم تسليمها فيما يتعلق بهذه الاتفاقية تُعَدُ قانونية، وتكون خطية ويتم تسليمها باليد، أو إرسالها بالفاكس، أو بالبريد المسجل بعلم الوصول، مع دفع الرسوم مسبقاً وتوجيهها للعنوان المناسب، أو إرسالها من خلال خدمة البريد السريع للطرف ذات الصلة الموجه له هذا الإخطار أو الموافقة أو الطلب أو التعليمات أو غيرها من المراسلات على العنوان التالي أو رقم الفاكس التالي:

My name is Mohamed and I have a B.A. in English language and literature from Mansoura University and a translation diploma from Cairo University, Egypt.
