Discussion

Mona Abdel Rahman May 19, 2010:
we shouldn't confuse "defense" and "challenge" - the word requested to be translated is دقوع
Anis Farhat May 18, 2010:
Well, this is the definition of "legal defense":In most litigation under the common law adversarial system the defendant, perhaps with assistance of counsel may alleged or present defense (or defenses) in order to avoid liability, civil or criminal. Legal defense is legally recognized justification for illegal actions, or acceptance that individuals were not legally responsible for their actions. When using legal defense the act must be voluntary, and the law recognizes duress unlawful pressure on a person to do what he or she would not otherwise have done. Duress usually includes force, threat violence, and physical restraint. The court don’t come to the verdict of guilty with everyone, children or juvenile delinquents can’t be found guilty for their actions. When the child reach a certain age they are not responsible for there actions. http://cjencyclopedia.com/index.php?title=Legal_defenses
You have to see which word suits your context.

thank you.
Mona Abdel Rahman May 18, 2010:
we don't have to say "legal challenges" as the context is a lawsuit before a court and any challenge may be accepted or rejected by the court, so it's enough to say "challenges" .

Just "challenges", because the context is legal, you don't need to add the word "legal"
Note from asker:
thank you, but- "legal challenges"?

motions

A motion is an official request by one of the parties to a case submitted either orally in court, as when a lawyer says, "we move to dismiss;"
ندفع لإسقاط الدعوى
or submitted in a written form (called a "brief"), which is what happens when the motion requires a lot of explanation and justification of fact and law.

ويسمى في لغة القانون العربية الحديثة دفعاً، ويُجمع على "دُفوع"، ويسمى مقدم الطلب الدافع

The myth, found among many translators who are unfamiliar with legal language, that دفوع means "defenses" comes from their unfamilarity with the singular form (and ultimately, from their unfamiliarity with the legal language). They somehow assume that دفوع is the plural of دفاع, or that the word دفوع is somehow related to دفاع because both words ultimately derive from the root verb دَفَعَ. In fact, دفوع is the plural of دفع, which means "motion," and it has nothing to do with "defenses" whatsoever, morphological derivation notwithstanding.
