محكمة التمييز هو الاسم الذي أخذت به بعض الدول العربية كما هو الحال في دولة الكويت ولبنان ، بينما أخذت دول عربية أخرى باسم محكمة النقض كما هو الحال في مصر وسوريا .
والتمييز لغة مصدر ميز ، يقال ماذ الشئ إذ عزله وفرزه وفصله ، ويقال إمتاز القوم إذ تميز بعضهم من بعض .
والنقض لغة - بكسر النون وضمها - معناه الشئ المنقوض أي المهدوم ، والنقض اسم لبناء المنقوض إذا هدم (1) . وقيل أيضا أن التمييز هو تفسير الشئ وتبيانه ، والنقض هو وجود علة بلا حكم (2) .
وقد أخذ على تعبير النقض قانونا - المأخوذ من التعبير الفرنسي Cassation الذي يعني الإبطال او الإلغاء - عيب لغوي وهو أنه يدل على أن محكمة النقض تنقض الأحكام رغم أن الواقع في الحياة العملية أنها تؤيدها أيضا إذا كانت صحيحة ، لذلك كان تعبير التمييز هو الأوفى بالقصد ، ورغم ذلك فإن تعبير النقض أصبح هو الدارج والمألوف والأكثر شيوعا .
ورغم الخلاف في المسميات ، تبقى حقيقة واحدة وهى أن أحدهما أو كليهما يقف على رأس الهرم القضائي في كل الدول التي تأخذ بهذا النظام .

Discrimination Appeal


Explanation:
In English, it literally translates as "challenge of discrimination" or discrimination challenge, but in accordance with legal language, at least in Canada and Britain, it's the noun phrase "discrimination appeal". Just be sure the context specifies what sort of discrimination appeal is in question.

As in, "Pro se plaintiff wins discrimination appeal against Post Office", or, "Court Hears Muslim's Race Discrimination Appeal." (both taken from two Canadian headlines)
